xAI has filed a lawsuit against a South Carolina man, alleging he bypassed safety protocols on its Grok chatbot to generate and distribute child sexual abuse material.

xAI, the artificial intelligence company owned by Elon Musk, has filed a lawsuit against Terry Wayne Harwood of South Carolina. The company alleges that Harwood intentionally bypassed safety protocols within its Grok chatbot to generate and distribute child sexual abuse material (CSAM). According to the lawsuit, Harwood used the tool to alter non-consensual images, converting them into sexually explicit content.
2. Criminal Charges and Legal Context
Harwood was previously arrested in February on eight felony charges related to the possession and distribution of CSAM. The current lawsuit from xAI asserts that at least some of the images involved in his criminal case were created or modified using the Grok platform. This legal action follows a period of scrutiny regarding Grok’s image-generation capabilities, which have been criticized for producing sexualized deepfakes. In March, a separate lawsuit was filed by a group of teenagers who alleged that the chatbot generated sexualized images of them as minors.
3. Damages and Company Response
In its filing, xAI claims that Harwood’s actions have caused the company significant reputational harm and exposed it to legal risk. The company is seeking financial damages from Harwood to cover the costs of its own legal defense in related matters. While Elon Musk has previously stated that users who generate illegal content with Grok would face consequences, this lawsuit marks the first time xAI has taken formal legal action against a user specifically regarding the creation of AI-generated deepfakes.
